Will and Probate for Emor S. Ballou

Wahoo, Saunders, Nebraska, November 14, 1893

In the name of God, amen. I Emor S. Ballou of the town of Ashland in the county of Saunders and state of Nebraska, considering the uncertainty of this mortal life and being of sound mind and memory, blessed be God for the same, do make and publish this my last will and testament in manner and form following that is to say:

First - I direct that my funeral charges and expenses of administering my estate and all my debts be paid out of my personal property. If that be insufficient I authorize my executors hereinafter named to sell so

much of my real estate as may be necessary for that purpose.

Second - I give and bequeath unto my beloved wife Susan C. Ballou all the personal property of whatsoever kind or nature, including all articles of wearing apparel, household good etc. that may be proposed of at my death.

Third - I give and bequeath to my beloved wife Susan C. Ballou the undivided one half interest I hold in the south one half (S 1/2) of the south west quarter (SW 1/4) of section twenty four (24) township thirteen (13) north, range nine (9) east, in Saunders County Nebraska, to have and hold in fee simple.

Fourth - I give and bequeath to my beloved wife Susan C. Ballou, in lieu of her dower the farm on which we now reside being the south east quarter (SE 1/4) of section thirty five (35) in township thirteen (13) north, range nine (9) east in Saunders County Nebraska (except seven acres sold to one O. M. Carter) and the east half of the north east quarter (NE 1/4) of section thirty six (36) township thirteen (13) north, range nine (9) east, in Saunders County Nebraska - and all other real estate I may have and own at the time of my death, except as herein before mentioned and described, to have and to hold during her natural life.

At the death of my wife, Susan C. Ballou, the real estate aforesaid I give and bequeath as follows -

The north one half (N 1/2) of the south east quarter (SE 1/4) of section thirty five (35) township thirteen (13) north, range nine (9) east, in Saunders County Nebraska - less the seven acres already sold - to my son Martin E. Ballou and his heirs forever.

I give and bequeath the east one half (E 1/2) of the south half (S 1/2) of said south east quarter (SE 1/4) of section thirty five (35) township thirteen (13) north, range nine (9) east to my daughter Susan H. Shepard wife of C. F. Shepard, and to her heirs forever.

I give and bequeath unto my daughter Elizabeth A. Stanley, wife of L. B. Stanley, the west half (W 1/2) of the south half (S 1/2) of the south east quarter (SE 1/4) of section thirty five (35) township thirteen (13) north, range nine (9) east, in Saunders County Nebraska.

I give and bequeath to my daughter Etta Green, wife of Jonathan S. Green, the east half of the north east quarter (NE 1/4) of section thirty six (36) township thirteen (13) north, range nine (9) east, in Saunders County Nebraska.

In case any of my children should die in my life time, leaving issue or descendants, I direct that his or her share shall not lapse, but shall be paid to such descendants in equal proportions.

Sixth - I appoint my beloved wife, Susan C. Ballou, my son Martin E. Ballou, and my son in law, C. F. Shepard executors of this, my last will and testament hereby revoking all former wills by me made.

In witness whereof I have hereunto subscribed my name this tenth day of March in the year of our Lord one thousand eight hundred and eighty six.

We whose names are hereto subscribed, do certify that Emor S. Ballou, the testator subscribed his name to this instrument in our presence, and declare at the same time in our presence and hearing that this instrument was his last will and testament, and we at his request sign our names hereto in his presence as attesting witnesses.

This is a codicil to my last will and testament bearing date of March 10, 1886.

My beloved wife Susan C. Ballou having departed this mortal life since the making of my said last will and testament, I hereby give and bequeath unto my beloved son Martin E. Ballou all of my personal

property of whatsoever nature or kind including all articles of wearing apparel, household goods that I may be possessed of at the time of my death.

It is my request and desire that all the other provisions of my said will be carried out as therein stated, each of said children receiving the property as therein slated to be given them after the death of my

beloved wife Susan C. Ballou, they to receive the same after my death.

In witness whereof I have hereunto subscribed my name this fourteenth day of November in the year of our Lord one thousand eight hundred and ninety three.

Ballou, the testator subscribed his name to this instrument in our presence, and in the presence of each of us, and declared at the same time in our presence and hearing that this instrument was a codicil to his last will and testament, and we at his request sign our names hereto in his presence as attesting witnesses.
