Edward Erwin vs. Benjamin Erwin.--Chancery. Writ, 1st April, 1771. Plaintiff very aged and infirm, and defendant made him drunk and induced him to sign a deed. Suit to annul.

John Erwin vs. Samuel Erwin--Rockingham. Slander. John Erwin deposeth, 15th August, 1793: In year 1776 plaintiff (Samuel Erwin) came to defendant's father's house and told defendant that himself and his brothers, Benjamin, Andrew, John and William Erwin, had come to agreement to value the land their father formerly possessed at £300, and that Samuel Erwin and his brothers, Benjamin and Andrew, had purchased the shares belonging to John and William Erwin. Deposition of Thomas Woodall, 25th March, 1797: John Erwin was a man of good character, but some persons spoke badly of him. Thomas is about to remove to Kentucky.
AUGUSTA COUNTY WILLS
- 19th April, 1755. Mathew Erwin's will: to wife, Elizabeth; to daughter, Gennet Erwin, alias Johnson; to daughter, Jean Erwin, alias Jamison; to daughter, Agnes; to daughter, Mary Erwin, alias Francis; to daughter, Ellinor Erwin, alias Patterson; to daughter, Elizabeth Erwin; to daughter, Ann Erwin, alias Anderson. Executrix, wife Elizabeth. John Francis to be overseer. Teste: James Bell, Alex. Blair, Edward Warner. Proved, 18th August, 1762, by Bell and Warner. Elizabeth refuses to execute. Administration granted John Francis, who qualifies, with James Bell, William Frame. (Book 3, Page 178)
- 15th February, 1761. John Erwin's will: to son Edward, part of plantation adjoining William Correy. Sons and daughters and wife. Executors, Andrew Erwin, Jean Erwin and son Edward. Overseers, brother Edward and Francis. Teste: James Oliver, William Curry, David Williams. Proved 19th November, 1762, by the witnesses. Edward Erwin qualifies executor (the others refusing) with Henry Smith, William Curry. (Book 3, Page 198)
- 30th May, 1765. Andrew Erwin's will, farmer--To wife Ann, to son Francis (unmarried), executors, entire estate. Teste: Andw. Scott, Saml. Corry, Benj. Erwin. Brother Edward and brother Francis to be overseers. Proved, 15th October, 1765, by Scott and Erwin. Executors qualify (Ann's mark), with John King, Samuel Patterson. (Book 3, Page 418)
- 13th January, 1772. Edward Erwin's will, of Long Glade--To sons, Edward and Francis Erwin; to Francess Brown, bed and furniture, if she behaves well and marry by consent; to son-in-law, Robert Law. Executors, sons Edward and Francis. Teste: Edward Erwin, Robt. Curry, John Erwin. Proved, 18th March, 1772, by Edward and John Erwin. Executors qualify with Wm. and Saml. Corry. (Book 4, Page 480)
