21 Nov 1842: Robert & Phebe Hudelson to Jesse Scott for $3000: NorthWest quarter of Section 4, Town 15

Whereas hereto for on the eighth day of July 1857 at the July Term 1857 of the Wayne Court of Common Pleas William C. Scott guardian of Horation H. Scott and Philander A. Scott infant children and heirs of Jesse Scott deceased and of Rufus J. Scott, Elizabeth Cornelia Scott and Mary F. Scott, children of James G. Scott, deceased and heirs of the said Jesse Scott late of Rush County, Indiana, deceased, filed in open court aforesaid, his petition setting forth that the said Jesse Scott died seized of the Northwest quarter of Section Four (4) in Township Fifteen 15 and Range Ten (10) East of the Second Meridian line except seventy acres sold, leaving ninety three acres and lying in the County of Rush and said State of Indiana and leaving a widow entitled to dower therein and twelve children and heirs to whom said land descended among whom were the said Horatio H. Scott entitled to one share, Philander A. Scott entitled to one share, and the children of the said Jesse Scott's deceased son James G. Scott viz. Rufus J. Scott, Elizabeth C. Scott, and Mary F. Scott, entitled to one share making three twelfths of the whole estate that the widow and adult heirs representing the remaining nine twelfths of said real estate had for the purpose of making some permanent provision for the widow and said infant heirs conveyed their interest in the said premises to the said William C. Scott and that a division into twelve parts could not be made without manifest injury to the estate and those concerned are praying the court for an order to sell the shares of the said infants and the appointment of a commissioner for the purpose of making said sale and the permission of the court that the said petitioner William C. Scott might be the purchaser of the shares of said infants as the court might direct. And afterwards ? on the 11th day of July 1857 of the Court aforesaid the said petitioner comes into said court and the court having inspected the petition, the deed from other heirs, the appraisement and having heard testimony touching the value of the land, interest of said heirs to order and decree that the said William C. Scott might become and he was thereby declared the purchaser of the said shares being the interest of the said heirs of said real estate at three hundred and thirty three dollars and thirty three and on third cents each making in the aggregate the sum of one thousand dollars the sum being the appraisal value thereof and the court appointed William H. Schlater a commissioner to convey the said heirs of said real estate to the said William C. Scott and his heirs as in and by the record and proceedings of the said court will more fully and at large appear. Now Therefore I do hereby in pursuance of the appointments and order of court aforesaid convey and confirm unto the said William C. Scott, his heirs and assigns the aforesaid three full equal and undivided twelfths parts (the whole into twelve equal parts to be divided) of the premises above described of which the said Jesse Scott died seized the same being the estate and interest of the heirsabove named therein to have and to hold the same with the appurtenances unto the said William C. Scott his heirs and assigns forever. In testimony whereof I William H. Schlater, the commissioner aforesaid have hereunto set my hand and seal this twenty first day of July anno domini one thousand eight hundred and fifty seven 1857.

This indenture made the seventeenth day of February Eighteen hundred and fifty seven (1857) between Andrew F. Scott and Martha Scott, his wife, Mary E. McClung, Francis N. Scott & Ellen his wife, Jane E. Wellborne and Peter C. Wellborne her husband, Ruth Ann Lowry & George Lowry her husband, Madison Albright surviving husband of Nancy D. Albright formerly Nancy D. Scott and Jesse E. Scott, heirs at law of Jesse Scott and Anna S. Scott widow of the said Jesse of the one part and William C. Scott of the other part witnesseth that where as the said Jesse Scott died in the County of Rush Indiana on the 6th day of May 1850 seized and possessed of the following described real estate being situated in the County of Rush and State of Indiana and being the Northwest quarter of Section No. Four (4) in Township fifteen (15) and Range Ten (10) East containing one hundred and sixty three (163) acres except (70) seventy acres sold and conveyed off the east side of said quarter under said seizure and possession 93 acres: which land descended to the following and only children and heirs at law of the said Jesse Scott subject to the dowers of the said Anna S. Scott the widow of the said Jesse; to wit: Andrew F. Scott, Mary E. McClung, William C. Scott, Francis N. Scott, Jane E. Welborn, Ruth Ann Mowry, Nancy Albright, Jesse E. Scott, adults, and Francis H. Scott, Horatio H. Scott, Philander A. Scott and the heirs of James G. Scott, twelve in number who now hold the said 93 acres of land as tenants in common. Now for and in consideration of the sum of five dollars fully paid the said Anna Scott the widow and the said Andrew F. Scott and Martha his wife, Mary E. McClung, Francis N. Scott and Ellen his wife, Jane E. Welborn and Peter Welborn her husband, Ruth Ann Lowry and George Lowry her husband, Madison Albright surviving husband of Nancy D. Albright deceased and Jesse E. Scott have granted, bargained sold and released and by these presents do grant bargain sell and release unto the said William C. Scott and his heirs and assigns forever all the right title interest claim or demand which they severally have of in or to said Court the part or portion conveyed by each heir being the one twelfth of said land and the widow her right of dower. In testimony whereof the said Anna Scott, Andrew F. Scott & Martha his wife, Mary E. McClung, Francis N. Scott & Ellen his wife, Jane E. Welborn & Peter her husband, Ruth Ann Lowry and George her husband, Madison Albright and Jesse E. Scott his ? have hereunto set their hands and seals on the day above.
