This indenture made the first day of June in the year of our Lord one thousand seven hundred and ninety eight, between George Bard, Adam Wolff and Henry Wolff Executors of the last Will and Testament of Peter Wolff late of Manchester Township in the County of York and State of Pennsylvania Esquire deceased of the one part, and Jacob Stambach of Codorus Township in teh County of York aforesaid Yeoman of the other part. Whereas a certain Peter Dicks and Clenor his wife, by indenture of bargain and sale under their hands and seals duy executed bearing date the fifteenth day of October in the year of our Lord one thousand seven hundred and seventy four, for the consideration therein mentioned did grant, bargain, sell and confirm unto the said Peter Wolff Esquire and to his heirs and assigns all the the following lot or parcel of land situate lying and being in Paradise Township in the County of York aforesaid, bounded and limited as follows (to wit) Beginning at a marked white oak standing on the West side of Punch Run, thence down the middle of the Great Road leading to York, North fifty two degress East sixty four perches to a Stone in the middle of the said road, in the line of Peter Dicks's land whereof this is part, thence by the same and other lands of Peter Wolff South sixty five degrees West sixty two perches to a post in the middle of Punch Run, thence down the middle of the said Run South twenty four degrees East fourteen perches to the place of beginning, containing two acres of land and the usual allowances of six percent for roads ?? To hold the same unto him, his heirs and assigns forever as in and by the said indentures recorded in the Office for Recording of Deeds in and for the County of York in Book F, page 93 ?? relation having thereunto had, may more fully and at large appear.
And whereas a certain Joseph Wilson and Martha his wife by indenture of bargain and sale under their Hands and Seals duly executed bearing date the third day of February in the year of our Lord one thousand and seven hundred and eighty one for the consideration therein mentioned did grant, bargain, sell and confirm unto the said Peter Wolff to his heirs and assigns, all that the following and described pot piece or parcel of land situate in Paradise Township aforesaid, bounded and limitted as follows, to wit, beginning at a black oak tree, a corner of the other lands of the said Peter Wolff thence with the same North twenty three degrees East sixty seven perches to a white oak tree makred for a corner, which is also a corner of Frederick Stobers land, thence iwth the same North eighty seven degrees and an half East thirteen perches toa Spanish oak marked for a corner thence by oher lands of the said Joseph Wilson South seventeen degrees East thirty perches to a marked white oak and south fifty five degrees West fifty eight perches to the place of beginning, containing seven acres and forty perches be the same more or less within the said described bounds and limits. To hold the same unto him and to his heirs and assigns forever, as in and by the said recited indenture recorded in the Office for Recording of Deeds in and for the County of York in Book AA, Page 143, relation having thereunto had, may more fully and at large appear.
And whereas the Commonwealth, by Patent on grant under the great seal bearing date the sixth day of April in the year of our Lord one thousand seven hundred and eighty nine for the consideration therein mentioned did grant and confirm unto Peter Wolff and to his heirs and assigns a certain tract of land called "Garden of Eden," situate in Paradise Township, bounded and limited as follows to wit, beginning at a marked black oak, thence by Peter Dicks's land North sixty six degrees East one hundred and twenty nine perches to a black oak, thence by Joseph Wilson's land North sixty one perches to a black oak, North twenty five degrees East seventy eight perches to a white oak, thence by Jacob Stams land North sixty five degrees West one hundred and twenty four perched and an half to a hickory, thence by vacant land South sixty five degrees West thrity perches to an hickory and west one hundred and twenty six perches to a black oak, thence by lands of George Leineweber South thirty five degrees West fifty seven perches to a small white oak, thence by the same and lands of the heirs of Philip Holtzel South forty eight degrees East fifty eight perches to a white oak thence by the same Holtzel's and Thomas Wilson's land South eleven degrees East one hundred and forty four perches to a black oak, thence by the said Wilson's land North eighty eight degrees East seventy eight perches to the place of Beginning, containing two hundred and eighty four acres and eight perches and allowances of six percent for roads?? with the appurtenances to hold the same to him his heirs and assigns forever, as in and by the said recited patent (recorded in the Rolls Office at Philadelphia for the State of Pennsylvania in Patent Book Number 13, page 523) Relation being thereunto had more fully and at alarge appears.
And whereas the said Peter Wolff by force and virtue of which said recited indentures and patent, in his lifetime became lawfully seized in his demesne as of fee, of in and to the above described three pieces and parcels of land with the appurtenances, and being so thereof seized, died, having first made and published his last will and testament in writing, bearing date the twenty second day of January in the year of our Lord one thousand seven hundred and ninety three, wherein he did nominate and appoint his loving son-in-law George Bard, and his sons Adam Wolff and Henry Wolff executors of his said last will and testament, and amongst other things therein contained did order and direct that his executors or survivors of them do sell and dispose of a certain tract of land, situate lying and being in Paradise Township in the County of York aforesaid, adjoining lands of Peter Dicks, Tempest Tucker, Frederick Stober, Thomas Bussell, George Kapp, Tobias Holtzel and John Hirschy Senior containing two hundred and ninety acres be the same more or less, either by public or private sale as to them the said executors or the survivors of them shall seem meet, and I do hereby impower my said executors or the survivor of them to make such deed or deeds to the purchsor, or purchasors thereof, as I myself might or could do, in as full and ample manner to all intents and purposes, as in and by the said will since his death duly proven and remaining in the Registrs Office at York relation having thereunto had, may more fully and at large appear.
And whereas, the said George Bard, Adam Wolff and Henry Wolff having taken upon themselves the burthen of the execution of the said recited will, and in pursuance thereof on the day of the date hereof did sell and dispose of the same at private sale unto Jacob Stambach (the party hereto) for the sum of two thousand pounds specie lawful money of Pennsylvania which being the highest price to be gotten for the same. Now this indenture witnesseth that the said George Bard, Adam Wolff and Henry Wolff executors as aforesaid for and in consideration of the aforesaidsum of two thousand pounds money as aforesaid to them in hand well and truly paid or secured to be paid by the said Jacob Stambach at or before the ensealing and delivery of these presents, the receipt and payment whereof is hereby acknowledged, have granted, bargained, sold, released and confirmed and by these presents according to the directions of the said recited will and by force and virtue thereof, do grant, bargain, sell, release and confirm unto the said Jacob Stambach and to his heirs and assigns, the said three described pieces and parcels of land, containing in the whole two hundred and ninety three acres and one hundred and thirty two perches and allowances be the same more or less, hereditaments and premises with the appurtenances together with all and singular the houses, out houses, edifices and buildings, barns, stables, gardens, orchards, medows, ways, woods, waters, water courses, improvements privileges rights members, hereditaments and appurtenances whatsoever there unto belonging or in any wise appertaining, and the reversions and remainders rents issues and demands whatsoever of him the said Peter Wolff at and immediately before the time of his death of in to or out of the hereby granted premises or any part or parcel thereof either at law or in equity, to have and to thold the said three contiguous pieces parcels and tracts of land, containing together in the whole two hundred and ninety three acres and one hundred and thirty two perches and allowance be the same more or less, hereditaments and premises hereby granted or meant or intended so to be with the appurtenances unto the said Jacob Stambach his heirs and assigns, to the only proper use benefit and behoof of the said Jacob Stambach his heirs and assigns forever, subject to the claims of the Commonwealth of Pennsylvania.
And the said George Bard, Adam Wolff and Henry Wolff for themselves their heirs executors and administrators and for every of them do hereby covenant and agree to and with the said Jacob Stambach his heirs and assigns by these presents that they the said George Bard, Adam Wolff and Henry Wolff, nor any or either of them have not willingly nor willingly done, suffered or committed any act, matter, cause or thing whatsoever whereby the hereby granted premises or any part or parcel thereof is or may be impeached or incumbered in title charge estate or otherwise howsoever, in witness whereof they the said George Bard, Adam Wolff and Henry Wolff, executors as aforesaid, the these presents have hereunto interchangeable set their hands and seals, dated on the day and year first and above written.
