York County, Pennsylvania, February 25, 1865

Last Will and Testament of John Stambaugh

In the name of God Amen, I John Stambaugh of Jackson Township in the County of York and State of Pennsylvania being in health of body and of sound mind, memory and understanding praised be God for the Same, do make this my last will and testament in manner and form following. First it is my will and I do order that all my just debts and funeral expenses be duly paid and satisfied, as soon as conveniently can be after my decease.

Item, it is my will that the proceeds of the same shall be equally divided among my ten children share and share alike.

Item, it is my will and I do order that Sarah Stambaugh daughter of Joseph Stambaugh shall have three hundred dollars to be a portion of said Joseph Stambaugh's share, and also I give and bequeath unto the said Sarah Stambaugh one sufficient bed and bedstand, one table, one bureau.

Item, it is my will and I do order that William Stambaugh son of Jesse Stambaugh shall have two hundred and fifty dollars out of his father's share or out of a bond which I hold against said Jesse Stambaugh becoming due in the year one thousand eight hundred and sixty eight to be given to him when he arrives at the age of twenty one years, the said money to be placed in the hands of my son George Stambaugh's hands and he to be the Guardian to hold said sum of money and to place the sum at interest until said William Stambaugh arrives to the age of twenty one years.

Item, it is my will and I do order that the bonds or obligations which I hold against my respective sons or children shall be given to them as the[y] become due, as a portion of their inheritance, and heretofore given to me by them and shall be given up to them after said bonds or obligations become due and as touching the residue of all and every the personal property which I may be possessed of after my decease shall be equally divided among all my children share and share alike.

And lastly I do nominate and constitute and appoint my sons Peter and John Stambaugh to be the executors of this my last will and testament hereby revoking all other will or wills by me heretofore made and declare this to be my last will and testament. In witness whereof I have here unto set my hand and seal the twenty third day of August one thousand eight hundred and fifty nine.

Before me, John M. Heiges, Register of the Probate of Wills and of Granting Letters of Administration in and for the County of York, personally appeared, Jesse H. Stambaugh and Michael Zartman, the subscribing witnesses to the foregoing will, who, upon being duly qualified according to law do depose and say, that they were personally present and saw and heard John Stambaugh of Jackson Township, the testator, sign, seal, publish, pronounce and declare the within and foregoing instrument of writing as and for his last will and testament, and the time of his so doing , he, the testator, was of sound and disposing mind, memory and understanding, to the best of their knowledge and belief, and that they witnessed the same at the request of the testator and in the presence of each other at the same time.

Memorandum: That letters testamentory on the foregoing will of John Stambaugh, dec'd, were granted to Peter and John Stambaugh, the executors named in said will, after being duly qualified according to the law on the 23rd day of January, A.D. 1865.
