The Wilbur Carkhuff home is rejoicing over the birth of a boy who arrived on Sunday night at the family home. THis is the fourth child in the family and there are now two daughters and two sons. The father carries the mail on Route 1.

The U. S. 10th Circuit Court yesterday upheld a U. S. District Court judgment against the American Smelting and Refining Co. in a $26,500 damage suit.
The suit stemmed from an accident on May 2, 1946, in which a truck, owned and operated by the company tumbled off the Million Dollar Highway near Ouray, killing four persons and injuring 10 others.
The dead and injured were employes of the Genesee Mine, operated by the George E. Collins Co., but were returning to Ouray on a truck driven by John Mitchell, AS&R mining superintendent.
The suit against the company was filed by Mr. and Mrs. Wilbur N. Carkhuff, whose son, George, was killed in the accident, and Andrew Sutyak, Thomas Harley Cline, Carl Berry and Alva Smith, who claimed injuries in the accident.
The opinion handed down by Judge Samuel G. Bratton and concurred by Judges Walter A. Huxman and Alfred P. Murrah held that the Colorado guest law did not hold in the case. The guest law stipulates a person hauling non-paying passengers cannot be sued for injuries by the passengers if an accident occurs and the driver is not found at fault.
The court held that the American Smelting and Refining Co. could be held liable for the negligence of the superintendent hauling employes of another company.
Mr. and Mrs. Carkuff were awarded $2500; Sutyak, $7500; Cline, $12,500; Berry, $2000, and Smith, $2000.
