But Not His Own, Mrs. Mabel Stambaugh Says.

Husband Just Can't Resist Mrs. Mitchell's Smiles.

Because, she says, her husband loves another man's wife, Mabel Bell Stambaugh filed suit in the district court today asking for a divorce, custody of the minor child and one-half of the property rights valued at $5,500. Mrs. Maude Mitchell is named the woman in the case.

Stambaugh and his wife were married in Hoton on Christmas day, 1907. Shortly after their marriage the husband began to make eyes at Mrs. Mitchell and her visiits to the Stambaugh home became so frequent as to arouse the suspicions of the plaintiff. Then, too, Stambaugh stayed out late at night and never gave a satisfactory explanation when he discussed the evening outings with his wife.

Last winter Mrs. Stambaugh took the baby and went to her father's home in Whiting. In February she met her husband at Elmont and an effort was made to effect a reconciliation. Stambaugh agreed to dispose of his property and move with his wife beyond the range of Mrs. Mitchell's alluring smiles. But he didn't. The next week he told his wife he had changed his mind and didn't want to live with her.

On June 24, the wife recites, her husband and the Mitchell woman met at Lecompton and came to Topeka and were seen here by Mrs. Mitchell's former husband. This conduct has injured the plaintiff's peace of mind, the petition recites, and made her married life unhappy. Because of the loss of her companion's love, she wants a decree of divorce, half of the property and the care and custody of the baby. She also asks for the return of her maiden name, Mabel Belle Miller.

Mr. and Mrs. Harry Briney of Topeka and Mr. and Mrs. F. M. Stambaugh and son, Floyd of Monticello neighborhood were pleasantly entertained at the Harry Stambaugh home Thanksgiving day. Mr. and Mrs. Briney were again guests there Saturday and Sunday. Mr. Stambaugh has been on the sick list for some time. The past few days he has had some one helping him with the road grading work.

The death of Harry Stambaugh was a shock to this community, while Mr. Stambugh had been in poor health for some time, no one realized his serious condition as he worked up to a few days previous to his death which occured Thursday afternoon, December 18. Mr. Stambaugh was forty-five years old. Funeral services were held at his home Saturday morning at 8:30, the Rev. Mr. Hill of the DeSoto Methodist church speaking words of comfort and consolation. Herbert Linden sant two songs, "The Old Rugged Cross" and "Somebody Knows." His relatives and a few of his many friends and neighbors were present to say the last tribute of respect. The beautiful floral offerings bore testimony of their love and friendship. He leaves to mourn their loss, his parents, Mr. and Mrs. F. M. Stambaugh and one brother, Floyd of Monticello neighborhood; one sister, Mrs. Briney of Kansas City, three children, one daughter of Topeka and one daughter and one son of the home address and a host of friends.
